Please read these Terms and Conditions (“Terms”) carefully. By accessing or using the services provided by Jersey Porch Designs (“us,” “we,” or “our”), you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Services Provided

Jersey Porch Designs offers professional design, installation, and removal of seasonal outdoor decor, primarily autumn pumpkin displays. Services are subject to availability and scheduling.

2. Bookings, Payments, and Cancellations

  • Booking & Payment: Services are booked via our website or direct communication. Confirmation requires any specified deposit or full payment. Prices are as listed or quoted and subject to change (not for confirmed bookings).
  • Payment Terms: A non-refundable deposit [e.g., 50%] may be required. Final payment is due [e.g., upon installation completion]. Payment is processed via secure third-party gateways; we do not store full card details.
  • Cancellations by Client:
    # 2 days or more notice: Refund beyond non-refundable deposit.
    # Less than 1notice: Full payment may be forfeited.
    # All cancellations must be emailed to [info@jerseyporchdesigns.com].
  • Cancellations by Jersey Porch Designs: Full refund or reschedule offered for unforeseen circumstances (e.g., severe weather).
  • Rescheduling: Subject to availability; fees may apply if within 48 hours..

3. Client Responsibilities

  • Access: Ensure clear, safe access to the property and display area at scheduled times. Delays due to obstruction may incur charges.
  • Site Preparation: Display area must be reasonably clean and ready for installation.
  • Outdoor Elements: We are not liable for damage to decor caused by extreme weather, vandalism, theft, or animals after installation.
  • Property Damage: While utmost care is taken, we are not liable for minor imperfections from installation/removal. Report significant damage caused by our negligence within 24 hours.

4. Intellectual Property

The Service and its content are the exclusive property of Jersey Porch Designs. Our trademarks may not be used without consent. Photos/videos of installations may be used by Jersey Porch Designs for marketing, unless otherwise agreed.

5. User Conduct (Website)

You agree not to use the Service unlawfully, disrupt its operation, transmit spam, impersonate others, or engage in bullying or hate speech.

6. Disclaimer & Limitation of Liability

Your use of the Service is at your sole risk, provided “AS IS” and “AS AVAILABLE.” We do not warrant uninterrupted or error-free service, nor that results will meet your requirements. Jersey Porch Designs, its affiliates, or employees are not liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Service, unauthorized access, or third-party conduct.

7. Indemnification

You agree to defend and indemnify Jersey Porch Designs against all claims, damages, and expenses arising from your use of the Service or breach of these Terms.

8. Governing Law

These Terms are governed by the laws of New Jersey, United States. Our failure to enforce any right does not waive that right. If any provision is invalid, the rest remain in effect. These Terms constitute the entire agreement.

9. Changes to Terms

We may modify these Terms at our sole discretion. Material changes will receive at least 30 days’ notice. Your continued use after revisions means you accept the new Terms.
